When it comes time to negotiating small business needs, it helps to have been through it time and time again.  There is, of course, an art form to it.  You can find a plethora of books on the topic.  It is not just being about being loud and bellicose and demanding the moon.  Knowing which chips are worth bargaining for and which chips are not worth the effort to bargain for is important.  So, do you know which transaction points you should fight about and which ones you should set aside?  We’ve negotiated many leases, many small business sales, and commercial properties, we’ve negotiated with just about everybody under sun.  Lenders, Landlords, Sellers, Buyers, Vendors, Creditors, Key Employees, Escrow Officers and Companies etc.  We’ve worked and negotiated with all of them.

Closing a TransactionThere are many keys, but the number one most important key is to know just exactly what you are negotiating for.  And, no, it is not the ‘best possible deal.’   It is actually specific terms that you have thought about and decided upon PRIOR to commencing negotiations.  Why, you ask?  Well, it is hard to know when to stop if you never defined it in the first place.  We have seen people who don’t know when to stop.  If you don’t know when to stop, there are two common occurrences, either you annoy the other side to the point where they leave the bargaining table, or you won’t be happy with whatever terms you accept, because you will always wonder if you should have asked for more, which increases the likelihood of cancellation during escrow or the Due Diligence Phase.
